It should've never happened. That's what Palm Beach County Sheriff Ric Bradshaw is saying about the sexual assault of an eleven year old girl.

20-year old Marvin Perez Lopez is accused of kidnapping her from outside her Lake Worth Beach home, and forcing her to his van to attack her.

The sheriff tells CBS 12 News that Lopez was in this country illegally after fleeing his native Guatemala and crossing the Mexican border in January.

"Here's a Guatemalan who came into the country illegally, was stopped by the Border people, released and made his way to South Florida."

He says Lopez turned himself in to U.S. Border Patrol and was given a court date for sometime in 2027 before being released.

It's believed he's been living in Palm Beach County since the end of January.

Bradshaw, a Democrat, blames the Biden administration for not doing more to secure the southern border.

Lopez is being held on no bond.
